Welcome to Caimio Agent, a personal AI assistant provided by Horus AI. These Terms of Use govern your access to and use of the Service, including its web and mobile applications. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Introduction

1.1 Overview

Caimio Agent is a personal AI assistant designed to help users with various tasks such as drafting emails, summarizing documents, analyzing files (e.g., images, PDFs, videos), and answering questions. The service integrates multiple Large Language Models (LLMs) including ChatGPT, Grok, LLaMA, Gemini, and other models to provide an optimal user experience.

1.2 Purpose of Terms

These Terms constitute a legal agreement between service users and Horus AI. They define the rights, obligations, and responsibilities of Users when using the Service, while protecting the Company's interests. User's use of the Service represents complete acceptance of these Terms.

1.3 Scope of Application

These Terms apply to all users, including but not limited to free users, paid users, and enterprise users. They also apply to all forms of Service access, whether through web browsers, mobile applications, or APIs.
2. Definitions
To avoid confusion, the following terms are defined as follows: "Service": Refers to Caimio Agent, including web applications, mobile applications, and any related interfaces. "User" or "You": Any individual or organization using the Service. "Content": Any text, images, files, or documents you upload or generated by the Service. "LLM": Large Language Models, including but not limited to ChatGPT, LLaMA, Gemini. "Subscription Plan": Service tiers you choose, such as Free, Basic, Pro, or Enterprise. "Personal Information": Data that can identify you, such as name, email. "API": Application Programming Interface that we may provide to enterprise users.
3. Registration and Account Access

3.1 Eligibility Requirements

You must be at least 13 years old to use the Service. If you are under 18, you need consent from your parents or legal guardian. You must provide accurate and complete information when registering (e.g., email, name).

3.2 Account Creation

To access the full Service, you need to create an account by providing a valid email address and creating a password or using accounts from approved third-party service providers. You are responsible for keeping your login information confidential and must not share it with anyone.

4. Subscription Plans and Payment

4.1 Subscription Plans

We offer the following subscription plans (subject to future changes): Free: Access to 3 LLMs, 10 conversations/day, 1GB storage. Basic ($5/month): Access to 10 LLMs, 50 conversations/day, 5 Projects, 10GB storage. Pro ($15/month): Access to all LLMs, unlimited conversations, unlimited Projects, 50GB storage, priority support. Enterprise ($50/month): Custom LLMs, API access, dedicated 24/7 support.

4.2 Payment Methods

Web: Payments are processed through third-party payment gateway Stripe. Mobile: Payment via In-App Purchases (Apple App Store or Google Play). All prices exclude taxes, fees, or charges arising from banks or payment providers.

4.3 Billing Cycle

Subscription plans will automatically renew monthly or annually (depending on your choice) unless you cancel. You will be charged on the start date of each billing cycle.

4.4 Cancellation

You can cancel your subscription plan at any time through account settings. Access will continue until the end of the current billing cycle. We do not provide refunds for unused periods unless required by law.

4.5 Plan Changes

You can upgrade or downgrade your plan at any time. Changes will take effect in the next billing cycle.
5. User Conduct and Prohibited Activities

5.1 Permitted Conduct

You may only use the Service for lawful purposes and in accordance with these Terms.

5.2 Prohibited Conduct

You agree not to engage in the following behaviors: Use the Service for illegal or unauthorized purposes. Upload or create illegal and unwholesome Content including but not limited to content that is violent, discriminatory, defamatory, pornographic, or misleading. Impersonate others or create fake accounts. Attempt to hack, disrupt, or overload the Service. Use the Service to infringe third-party intellectual property rights. Distribute malicious code, viruses, or harmful software through the Service.

5.3 Third-Party Compliance

Since the Service integrates third-party services, Users must also comply with the terms of use of those providers.
6. Intellectual Property Rights

6.1 Your Content

You retain ownership of Content you upload to the Service. By uploading, you grant us a non-exclusive, royalty-free worldwide license to use, store, and process Content to provide and improve the Service. You are fully responsible for the legality and copyright of Content you upload. The Company is exempt from all legal liability related to Content uploaded by Users.

6.2 AI-Generated Content

You are granted a non-exclusive, royalty-free worldwide license to use Content generated by the Service for personal or commercial purposes, provided you comply with applicable laws. We are not responsible for the legality of AI-generated Content if you use it for improper purposes.

6.3 Our Intellectual Property

The Service, including software, design, interface, trademarks, and source code, is owned by Horus AI and protected by Vietnamese and international intellectual property laws. You may not copy, modify, distribute, or reproduce any part of the Service without written consent from the Company.
7. Data Security

7.1 Data Collection

We collect User email, name, and chat history for the purpose of providing and improving the Service. Full details are in our Privacy Policy [link].

7.2 Storage

Phase 2: Data is stored locally on your device with AES-256 encryption. Phase 3: Data will be moved to secure cloud storage, compliant with GDPR and CCPA.

8. Disclaimers

8.1 "As Is" Basis

The Service is provided on an "as is" and "as available" basis without any warranties, including but not limited to uninterrupted access, error-free operation, or freedom from malicious code.

8.2 AI Results

We do not guarantee the accuracy, completeness, or reliability of AI-generated Content. You are responsible for verification before using it for important decisions.

8.3 Usage Risks

You accept all risks when using the Service, including the possibility of data loss or damage due to system errors.
9. Limitation of Liability

9.1 No Indirect Liability

We are not liable for indirect, incidental, special, or consequential damages (e.g., loss of profits, data, reputation) arising from use of the Service.

9.2 Liability Limitation

Our maximum liability to you shall not exceed the amount you paid for the Service in the preceding 6 months.
